Reading about buy sell deals all week, and talking to people about them, I start to notice trends. One thing I noticed a few months ago was that Nissan seemed to be creating clusters of stores in one area under the same owner. Sources in the buy sell world confirmed that was indeed occurring.
Nissan’s strategy has been challenged in court but the challenge failed. For sure Nissan’s cluster strategy doesn’t approach the level of concentration that say Saturn’s strategy of awarding all the stores in a DMA to one owner did. But it may cause problems down the road. I look at that issue this week.
One way Nissan has executed this strategy is by exercising its Right of First Refusal. ROFR, as it is known, is being used more these days by many manufacturers. Also this week, Mark Johnson suggests ways sellers and buyers can strengthen their defenses against ROFR.
